Is my company name protected by incorporation?
Incorporation only prevents the State of Florida Division of Corporations from filing a document to create another business entity with the same or deceptively similar name as your company's name. It is your duty to protect its name and the goodwill associated with it.
Because there is no national registration of trade names, most companies protect their trade names by registering them as a service mark or trademark.
